Criminal Procedure Code (V of 1898)
Ss. 174 and 176 Exhumation---- Locus standi- - - Candidates were legitimate successors to expired persons and were wronged by a request passed by two courts beneath coordinating the exhumation or disinterment of the departed to decide the reason for death. The supplication raised by the solicitors was that the application was moved by a more peculiar person who had no locus standi to look for exhumation. Legitimacy For making an application under S.176(2), Cr.P.C., nothing was vital with the exception of the fulfilment of the judge, just to the degree that exhumation was convenient for knowing the reason for death. Such a request was constantly intended to eliminate mists in this manner; carefulness was to be practised as such regardless of whether a solitary sensible situation or doubt so supported in light of the fact that because of death' would sit idle; however, it was to decide if to set criminal hardware into motion, etc. Exercise of exhumation couldn't be kept simply on account of getting demand made by any more peculiar, assuming in any case conditions so legitimised. For bringing regulation into movement, the prerequisite of a blood connection was never demanded.
